Police Now Examining Evidence in the Stolen iPhone Prototype Case

CNET is reporting that the authorities are now examining evidence collected from Gizmodo editor Jason Chen’s home after Gizmodo published the story regarding the stolen iPhone. Chen’s lawyers raised concerns regarding the legality of the seizure, which caused the delay in examination.

Stephen Wagstaffe, chief deputy district attorney for San Mateo County, told CNET on Wednesday that a court there had appointed a “special master” to search the items seized from the home of Jason Chen in late April. The court has asked the special master to collect only information that pertains to Gizmodo’s dealings with an iPhone prototype that the blog purchased for $5,000.

The unidentified special master is a neutral third party appointed by the court to carry out orders. This person will collect what they believe is information important to the investigation and present it to both Chen’s lawyers and the court for discussion and ultimately a decision on what goes to the local district attorney for investigation. This could take up to two months to complete.

This is a great time to remind everyone that Apple CEO Steve Jobs wasn’t going to let this “slide“.
