Apple Awarded 'There's an App For That' Trademark

TUAW is reporting that the U.S. Patent and Trademark Office is approving Apple’s registered trademark of the advertising line: “There’s an app for that.”

Apple filled for the trademark in four separate classes in December 2009, and was allowed the usage in May of 2010, but still needed to provide evidence that the company has used it in commerce, so that the USPTO could finalize the registration. Apple then in August requested to divide the trademark into two separate applications, and filed the “Statement of Use” evidence that Apple was indeed using the trademark in commerce.

Last week the USPTO granted Apple the division of the application, and the government attorney in charge of the application signed off on the Statement of Use and has authorized the mark for final registration.

Here are the classes it is authorized for:

035: Retail store services featuring computer software provided via the Internet and other computer and electronic communication networks; retail store services featuring computer software for use on handheld mobile digital electronic devices and other consumer electronics

042: Maintenance and updating of computer software; providing information concerning computer software via the Internet and other computer and electronic communication networks; providing search engines for obtaining data via communications networks; providing temporary use of computer software and online facilities to enable users to access and download computer software; providing online non-downloadable computer software that generates customized recommendations of software applications based on user preferences

I would say this is an odd trademark filing considering Apple doesn’t seem to be using this line in their advertisements as of late, however, if you look at it in the other direction, it looks as if Apple is going to be using this line in the future. At least enough to register a trademark for it.
