Apple Files Suit Agains Amazon Over ‘App Store’ Trademark

194052-amazonappstore.pngBloomberg is reporting that Apple has filed a lawsuit against Amazon over the use of the term “App Store.” Apple filed the suit on March 18th, in an attempt to prevent Amazon from further using the term in the introduction of that company’s new “Amazon Appstore“, which will sell Android Apps.
Here’s an excerpt:

“Amazon has begun improperly using Apple’s App Store mark in connection with Amazon’s mobile software developer program,” Apple said in the complaint. Amazon also plans to use the name with a mobile software download service, the complaint states.

This is just another chapter in the ongoing saga of the App Store name. Apple filed for the trademark in 2008, and was given approval last year. However, Microsoft has been fighting this approval claiming that Apple is trying to trademark a generic term. Apple sees it differently. Anyway, the report claims that Apple contacted Amazon three separate times in an attempt to asking them to stop using the term.

Personally, even if Apple is in the right (I’m no lawyer), I think this makes them look like a bully. We’ll have to see how this plays out. If I had to guess, Apple will win, simply because they were there first.
