The Loop is reporting that Apple, Motorola, RIM, Nokia, and 28 other similar companies are being sued for infringement on patent held by H-W Technology. The suit itself was filed in the Dallas District of Texas, and points out that these companies infringe on their patent called “Internet Protocol (IP) Phone with Search and Advertising Capability”, a patent awarded to H-W in 2009.
The patent itself is described as such:
“A software platform in an Internet Protocol (IP) phone having the ability to be used with different communication infrastructures such as broadband, wireless communication and Plain Old Telephone System (POTS) service. Further, the software platform in the IP phone has the ability to be used with different applications operating on the IP phone. Further, the IP phone has the ability to perform additional functionality than traditional Public Switched Telephone Network (PSTN) phones, such as searches and advertising, given its ability to converge voice and data within a single terminal.”
Yeah, I don’t understand any of it either. At any rate, H-W Technology claims that this patent also relates to smart phones, which is why these other companies are in trouble.
As for what H-W Technology wants for their trouble is as follows: cash damages, enhanced damages for knowingly infringing on the patent, and a permanent injunction. So, there’s that.
