Computerworld points out that Psystar has stopped selling their line of Mac Clones after the recent settlement agreement with Apple. The entire line of machines are currently listed as “Out of Stock” on Psystar’s site, but they do continue to offer their Rebel EFI software, which allows users to install their own copy of Mac OS X on Psystar’s generic PCs.
In the mean time, Psystar plans to appeal the federal court’s ruling in Apple’s favor in this ongoing copyright infringement case.
“We will take the case up with the Ninth Circuit,” said Psystar’s chief attorney K.A.D. Camera of the Houston firm Camera & Sibley LLP. In an interview late Tuesday, Camera said Psystar will file an appeal with the U.S. Court of Appeals for the Ninth Circuit over a Nov. 13 summary judgment by federal Judge William Alsup, who said Psystar violated Apple’s copyright as well as the Digital Millennium Copyright Act (DMCA) when it installed Apple’s operating system on the clones it sells.
“We think that Judge Alsup got it wrong,” said Camera. “The effect [of the settlement] is to allow the case to be heard by the Ninth Circuit,” he continued, and characterized the settlement as “extremely favorable” to Psystar.
All of these developments only pertain to Mac OS X Leopard on Psystar systems. In a developing second case in Florida, Psystar is claiming that Apple is in violation of antitrust laws by limiting Mac OS X Snow Leopard to only run on Apple hardware. This being the same justification Psystar has used for the first lawsuit against Apple, except the software in question was Mac OS X Leopard.
Apple’s request for a permanent injunction that would prevent Psystar from selling Mac OS X for generic PCs. The request will be heard on December 14th, there it will be decided if the injunction will be granted, and what software it affects.
For the sake of their continuing survival, and everyone else’s mental health, Psystar needs to drop it.
