Apple released the new AppleTV2,1 Firmware (Build 8M89) on their servers late yesterday. So far, the firmware does seem to be based on iOS, specifically version 4.1. If you are so interested, you can download the firmware here.
Of course, no one can do anything with the firmware as of yet aside from trying to reverse engineer it in an attempt to jailbreak it. That said, once customers who ordered the new Apple TV receive their orders (any day now) they can use this firmware download to reset their device to factory settings. Owners of the previous generation Apple TV can’t use the new firmware due to hardware differences between the two devices.
With Apple releasing the firmware, and it being based on iOS, it’s only a matter of time before someone jailbreaks the new Apple TV.
