Even though Apple included a clause about location tracking in their EULA, they should make a more obvious warning about this on the device for good measure. That would make the whole thing go down a little easier.

The biggest issue here, in my humble opinion, is Apple’s uncharacteristically poor execution in this department. We’re hearing that this may be a bug. Was this bug there all the way back in the iPhone 3G? That’s a long time not to catch this. How about the fact that the data persists through a hard reboot? Then there is the fact that the data is transfered to your computer, and isn’t encrypted in any of its locations? For a company built on polished products and programming, they really wiffed on this one. If they had done better, there wouldn’t be near as much tempest in this teapot.
