The patents that Apple infringed upon are part of the spec for wireless communications that Nokia had written into the spec under the agreement that they would give anyone access to them on FRAND terms. But Nokia was greedy and wanted access to Apple’s IP in the iPhone.

Now that Nokia are building Windows phones they have effectively grandfathered in some of that iP with the Microsoft / Apple deal that is already in place.

Short version. Nokia caved with some more reasonable royalty rates.
