Reports Claim Apple’s Evidence in Samsung Galaxy Tab Case is Flawed

As we noted just the other day, Apple was granted an injunction barring the sale of Samsung’s Galaxy Tab 10.1 in the European Union, except for the Netherlands, due to Apple’s infringement suit regarding the device’s design similarities to the iPad.

It is now being reported by Computerworld that their dutch affiliate site, Webwereld.nl has found an issue with a keystone piece of evidence being used by Apple in the suit. Specifically, the report points to one exhibit, where the image of the Galaxy Tab has been stretched to look more like an iPad than it actually does. In the exhibit the Galaxy Tab has a 1.36 aspect ratio as compared to the iPad 2’s 1.30 aspect ratio. In reality the Galaxy tab has an aspect ratio of 1.46, far from the iPad’s.

Apple case hinges on the claim that the Galaxy Tab 10.1 is “practically identical” to the iPad. Submitting false evidence, intentionally or otherwise, could damage Apple’s case. Of course, that remains to be seen if Apple’s lawyers deliberately manipulated the Galaxy Tab image, or if they simply used an older, out of date, promotion image for this purpose. Either way, it’s just a sloppy job of handling evidence by Apple’s lawyers.

Lastly, Apple also submitted other pieces of evidence, some much stronger than this one. For instance, Apple has submitted images with both the iPad and Galaxy Tab 10.1 side-by-side in real life, and not just some shoddy promotional pictures. So, it remains to be seen how this is going to play out for Apple.
